I am about 18 months into an IVA which concerned both me and my wife.We are now getting divorced and she is leaving the country.I wil not have any surplus at all now as her wages were included in the calculation. Will I need to go bankrupt ?

Hi Chris h and welcome to the forum

Has your wife confirmed that she will not continue to assist you with your IVA payments? I assume she has and that she is not in an IVA.

If you are left with no surplus income at all, then you cannot continue to make your IVA payments and the IVA will fail. The Supervisor will probably then proceed to make you bankrupt, assuming that he/she is required to under the terms of your proposals.

This is happening to you as a result of something which is out of your control, so don't worry. At lease bankruptcy proceedings will take away your debt problems for good.
