Will my sister be liable for all the debt ?

Hello My sister has an IVA with her husband, having taken it out a year ago. They are splitting up and she fears he is leaving the country. Will she be liable for all the debt and monthly payments? She is on a low income and cannot afford this. Would they split the total debt?

Hello Tania and welcome to the Forum.

Is the IVA solely in either hers or her husbands names or are they interlocking ones?

If they are interlocking, then her husband will still be liable for his own.

There should be no problem with your sister continuing with her IVA so long as she can afford her share of the repayments. She is best placed by speaking to her own IP about this, as he/she has detailed knowledge of her case.
