If you send a letter of appeal or notice of intended appeal you will keep them wondering and on the hop, they will know that you are aware of your rights and if nothing else will you have the pleasure of knowing that you are causing them some concern. From your posts I would suggest that you won't get anywhere with the appeal but as others have stated you do have to follow this route if you eventually want to take them to task by legal means. You may decide after your appeal and once the bitterness has subsided that you just want to put this behind you but you can get some satisfaction in knowing you have caused them some concern in the meantime, and belive me it does. I have been both sides of the fence and on the employers side there is always a sigh of relief when each deadline passes! I just feel that there were other options open to your employer rather than this heavy handed approach in dismissing you for gross misconduct after all none of us that have financial difficulties do so intentionally. I wouldnt mislead you in saying that you would win a tribunal but you certainly have grounds for giving it a try. Your health and well being are the most important thing here and there is only you that knows whether you feel you would be up to what can be a longwinded process, but I would certainly keep them guessing!

Just sat down and re-read the notes from the disciplinary hearing. They adjourned for 10 minutes and then came back with my credit report which just happened to turn up in that 10 minute window. They also adjourned for 15 minutes before coming back to tell me I was dismissed.
Not long to ruin everything.

Hi Sharon Thanks for your advice. They gave me their decision at the end of the meeting. They had a adjournment and then when I went back in I was told I was dismissed for Gross Misconduct. I have sent a letter today asking for a copy of my personnel file and again for a copy of the recording that was made.

The problem is I didn't appeal in the time limit. I should have notified them that I was going to appeal by Friday but I couldn't go through the experience again.

Hi.
I would not worry about what there Terms and Conditions say about your appeal, you are in shock and feel humiliated and just felt that your world had just caved in.
Visit the C.A.B and ask what they can do for you under English Law i feel you can win this dont be scared of them because you can win.
Anyone can set there own rules but in a court of Law is different.

Good luck with the Appeal, I personally think this company has treated you terribly. I really believe you have a case for unfair dismissal here. I certainly would not want future employers being told I had been dismissed for gross misconduct. And would fight them all the way, and not be bullied by them.

How is being in a IVA work related and gross misconduct anyway? It is personal between you, your IP and your creditors and nothing to do with them.

I would clear your name in an appeal and start looking for something else with an employer who can appreciate you as a person and see past credit problems which you are dealing with.
We're willing to wipe the slate clean, give you a fresh start. All that we're asking in return is your cooperation.

The attitude of these companies is shocking. If you had done anything underhand or illegal then fair enough. You have only faced upto your problems and tried to sort them out the best way you can, and they dismiss you. Maybe a bit of care and support from these organistions wouldn't go a miss.
