I have a sound case, and whilst I dont know if the builder has the money in the bank, I do know that he is a bus driver which can be quite a well paid job, and I believe that an attachment of earnings would be possible if I win the case

I would give BE a ring in the morning to discuss the builder problem.

They may be able to assist.

You would only obtain a successful attachment of earnings order if he has disposable income to repay you and has not kept to the repayment schedule set by the court.
I would think that your supervisor will be your insolvency Practitioner at B&E
