my husband is thinking of declaring himself bankrupt after struggling with his company for 3 years now,i have e seperate bank account and our house is rented .would my assets be taken from me even though they are not in my name and we have seperate accounts?

I do not think they can take your assets.Any thing in your husbands name probably is at risk.

Hi wma and Welcome!

As it’s your husband’s bankruptcy your assets should not be touched, however Andy makes a valid point that this is a different case if assets of your husbands are now in your name.

An OR will search back five years to see whether any major assets that were in your husbands name have been sold, transferred etc.

Your assets are protected as it is only your Husband who is going bankrupt and as such on his assets that are at risk.

Andy makes a good point that states if any assets which were moved to you to concel them.

Remember though that in bankruptcy the court is not going to be interested in everyday white goods and household items such as computers and TVs. The court will only be interested in items with significant value.
