My wife is currently with Debt Management for debts which she had in her maiden name. She has been advised to apply for an IVA and has been told she would need to register it in her married name but to quote her maiden name as reference. As the debts are prior to us getting married would they be entitled to any of my earnings?

Hi mattij and welcome to the forum

I am afraid that these days it is getting very difficult for the non-insolvent spouse to ringfence his/her income away from their partners.

Your wife does need to take professional advice regarding her options, but if she really wants to try an IVA you will have to be prepared to disclose your income and expenditure and perhaps contribute towards the payments.
